GAINESVILLE, Fla., May 2 (UPI) -- A Florida Taco Bell customer accused of shutting down the eatery's computer network by throwing soda on a cash register was charged with a felony.

The Gainesville Police Department said Suresh Chapman, 30, was upset about his order not being prepared correctly Sunday night so he threw his soda on the cash register, causing the restaurant's computer network to go down for several hours, the Gainesville Sun reported Wednesday.

Police said officials with the Taco Bell location said the damage cost about $2,500 to repair and the eatery lost about $3,000 in revenue as a result of the damage.

Chapman was charged with a second-degree felony of damaging a computer resulting in a loss of $5,000 or more and a probation violation from a 2011 child abuse case. He was ordered held without bail.

Answer:

Nearly infinite.

The customer was being a thoughtless dickhead. He should certainly pay full restitution and suffer a year or two of probation. And a short stay in lock-up wouldn't be unreasonable, either. But being saddled with a life-long felony record for that sort of impulsive non-violent act isn't reasonable.

OCD_OCD: The Federal Sentencing Guidelines are completely screwed up. It's a one-stop shopping list and the judges are given very little, if any leeway in sentencing. If they do not follow the sentencing guidelines to the letter, then they must jump through hoops to explain why and their explanations are then reviewed.

If that's the case, then why have judges at all? Just slap them in jail and dispense with the entire legal procedure. It makes me crazy.

I would guess that there may be felony statutes with in state criminal codes that aren't listed in federal codes, thus those felonies wouldn't be federal ... couldn't be.

There very well may be a federal statute that covers the act of throwing a soda into a cash register, but the article doesn't refer to that. It all likelihood, it's being prosecuted under Florida law.

If a felony CASE isn't prosecuted in a federal venue, under federal law, it's not federal.

OCD_OCD: Maybe I should have explained it better.

Felonies are federal charges but some charges go through the state District Courts rather than federal courts if they are lesser offenses.

It can be VERY confusing because the federal authorities can adjust just about anything they want under felony violations.
